Los matrimonios y uniones infantiles tempranos y forzados se definen como una unión en la que al menos uno de los contrayentes es menor de 18 años. La inmensa mayoría de los matrimonios y las uniones infantiles, tanto de derecho como de hecho, afectan a las niñas, aunque a veces sus cónyuges también son menores de 18 años. Tal como lo señala la Recomendación general núm. 31 del Comité para la Eliminación de la Discriminación contra la Mujer y la observación general núm. 18 del Comité de los Derechos del Niño sobre las prácticas nocivas, adoptadas de manera conjunta en 2014, y la Resolución 29/8 aprobada por el Consejo de Derechos Humanos el 2 de julio de 2015 sobre la intensificación de los esfuerzos para prevenir y eliminar el matrimonio infantil, precoz y forzado, el matrimonio infantil se considera una forma de matrimonio forzoso, ya que no se cuenta con el consentimiento pleno, libre e informado de una de las partes o de ninguna de ellas. La definición que se aplica para enfrentar esta vulneración de los derechos humanos de niñas, niños y adolescentes, incluye tanto a los matrimonios correspondientes a vínculos conyugales reconocidos por normas legales, consuetudinarias o religiosas, como a las uniones que dan cuenta de una relación de pareja con cohabitación sin reconocimiento legal.
